What is Title IX
Title IX of the Education Amendments of 1972 (20 U.S.C. § 1681) provides that no person shall, on the basis of sex, be excluded from participation in, be denied benefits, or be subjected to discrimination under any education program or activity receiving federal financial assistance.
The Equity & Compliance Director/Title IX Coordinator:
- Promotes the creation of policies, procedures and notifications designed to ensure university compliance with Title IX and the Sexual Misconduct Policy
- Oversees implementation of compliance procedures, including investigation and disposition of Title IX and Sexual Misconduct complaints
- Acts as liaison to the state and federal agencies that enforce Title IX
- Monitors all other aspects of the university’s Title IX/ Sexual Misconduct compliance

Non Retaliation Statement
Anyone who has made a report or complaint, provided information, assisted, participated or refused to participate in any investigation or resolution under applicable Board or institution policy shall not be subjected to retaliation. Anyone who believes they have been subjected to retaliation should immediately contact the appropriate department or individual(s) for that institution. Any person found to have engaged in retaliation shall be subject to disciplinary action, pursuant to the institution’s policy.

How to File a Report
Students, Faculty, and Staff who believe they have been a victim of sexual misconduct may file a written or verbal report to Kimberly Carter, Title IX Coordinator, at 229.500.3304 or visit us in person.
Guide for Employees
Under Title IX, Albany State University is obligated to investigate and potentially take action when an incident of sex or gender discrimination or sexual misconduct is made known to a “responsible employee.” A responsible employee is defined as: (a) any employee who has the authority to take action to redress the harassment, discrimination or misconduct; (b) any employee who has the duty to report harassment, discrimination or misconduct to appropriate school officials; or (c) an individual who a student could reasonably believe has this authority or responsibility.
The University System of Georgia (USG) has further defined an employee’s role in reporting sexual discrimination and misconduct, and refers to such individuals as “mandatory reporters.”
The USG has made the following guidelines available to mandatory reporters:
Responsible employees are defined as all faculty, staff (excluding confidential and privileged resources) and all resident assistants, student employees, and graduate assistants, unless specifically designated as a confidential or privileged employee.
Counseling and Student Accessibility Services and Student Health Services considered privileged resources. Staff working in these areas are not considered responsible employees for purposes of Title IX and do not have an obligation to report incidents of sex or gender discrimination or sexual misconduct unless requested by the individual. Obligations for reporting child abuse however, may exist under state law.
A responsible employee must promptly contact the Title IX coordinator when they received information concerning an alleged act of sex or gender discrimination or sexual misconduct. The responsible employee must provide all reported information including the names of the victim and the accused, as well as details concerning witnesses, location, etc.
A responsible employee, as much as possible, should preemptively inform a student or member of the Albany State University community that the university will attempt to maintain confidentiality but that he or she is required to report all allegations, including the names of those involved, to the university. While confidential resources are available, no employee should promise confidentiality.
The Title IX coordinator will promptly notify public safety and other university officials, when appropriate. At the request of the disclosing individual – responsible employee may contact law enforcement or other resources.
Sanctions for responsible employees failing to report incidents of sex or gender discrimination or sexual misconduct may include disciplinary action up to and including termination from the university.
Pregnancy, Lactation, and Recovery
Title IX of the Education Amendments of 1972 provides for equal educational and employment opportunities for pregnant and parenting students, staff, and faculty. It prohibits educational institutions from discriminating against pregnant students and employees based upon their marital status and prohibits discrimination because of childbirth, false pregnancy or recovery from related conditions. Students, faculty, and full-time and part-time employees are covered by Title IX’s protection regulations.
In compliance with Title IX, ASU provides individualized support to students, staff, and faculty to ensure full access and participation in education, employment, and university services and programs. Students in need of pregnancy or parent related accommodations can schedule an appointment by contacting Counseling and Accessibility Services at 229.500.2013. Faculty and staff in need of workplace accommodations can contact Human Resources at 229.500.2026.
